For the sake of extremities, we will say that it pierces your passenger side of the car and plows into your empty passenger seat. It could have just as easily slammed through your side of the windshield and plowed right into your face.
In any event, who’s fault would the accident be? Would it be yours for noticing movement on the ladder and failing to move out of the way, or warn the other driver? Or would it be the fault of the person who failed to tie it down properly before they decided to drive upwards of 75 miles per hour on the highway?
If this catastrophe caused you to swerve your vehicle into other traffic and you were injured as a result, then other people that were involved as well got injured…what do you think the insurance people for the truck with the ladder would try to say?
